Les parents \u00e9taient pr\u00eats \u00e0 vendre de gr\u00e9 \u00e0 gr\u00e9, au sein de la famille, et acceptaient de le faire sous la valeur marchande\u00a0: un transfert g\u00e9n\u00e9rationnel que les familles font r\u00e9guli\u00e8rement, g\u00e9n\u00e9ralement avec de bonnes intentions et pas toujours avec la meilleure structure.<\/p><p dir=\"ltr\">La situation du client rendait la question de la structure plus complexe que d'habitude. Il avait de la valeur nette dans sa maison actuelle, mais il portait aussi de vraies dettes de consommation, des cartes de cr\u00e9dit et des marges de cr\u00e9dit qui pesaient sur ses liquidit\u00e9s mensuelles. L'occasion d'acheter \u00e9tait r\u00e9elle, mais elle arrivait par-dessus un portrait financier d\u00e9j\u00e0 sous une certaine pression.<\/p><p dir=\"ltr\">La plupart des clients dans cette situation prennent le chemin le plus direct. Acheter la propri\u00e9t\u00e9 au prix r\u00e9duit, payer aux parents ce qu'ils demandent, et passer \u00e0 autre chose. Les parents ne cherchaient pas \u00e0 obtenir la pleine valeur marchande. Ils renon\u00e7aient volontairement \u00e0 une partie de cette valeur pour faciliter le transfert dans la famille. En termes hypoth\u00e9caires, ils cr\u00e9aient un don d'\u00e9quit\u00e9.<\/p><p dir=\"ltr\">Quand une propri\u00e9t\u00e9 est vendue au sein d'une famille sous sa valeur marchande \u00e9valu\u00e9e, la diff\u00e9rence entre la valeur \u00e9valu\u00e9e et le prix de vente r\u00e9el peut \u00eatre trait\u00e9e comme un don d'\u00e9quit\u00e9 du vendeur \u00e0 l'acheteur. L'acheteur peut alors demander une hypoth\u00e8que fond\u00e9e sur la pleine valeur \u00e9valu\u00e9e plut\u00f4t que sur le prix de vente r\u00e9duit. La portion en don d'\u00e9quit\u00e9 joue le r\u00f4le d'une mise de fonds. Bien fait, cela ouvre une capacit\u00e9 d'emprunt qu'un achat direct au prix r\u00e9duit n'aurait pas produite.<\/p><p dir=\"ltr\">Dans ce dossier, la marge cr\u00e9\u00e9e par le don d'\u00e9quit\u00e9 \u00e9tait significative. Elle suffisait \u00e0 faire plus que compl\u00e9ter l'achat. Avec cette \u00e9valuation en main, nous avons recadr\u00e9 la transaction. Les parents ont ajust\u00e9 le prix d'achat officiel \u00e0 la valeur \u00e9valu\u00e9e, et la diff\u00e9rence entre ce montant et ce qu'ils avaient d'abord accept\u00e9 a \u00e9t\u00e9 document\u00e9e comme un don d'\u00e9quit\u00e9.<\/p><p dir=\"ltr\">L'hypoth\u00e8que a \u00e9t\u00e9 structur\u00e9e sur la pleine valeur \u00e9valu\u00e9e. Le don d'\u00e9quit\u00e9 couvrait une part importante de la mise de fonds, ce qui laissait de la place pour un retrait de valeur nette \u00e0 la cl\u00f4ture. Le client a utilis\u00e9 ces fonds pour rembourser les dettes de consommation de son bilan. Cartes de cr\u00e9dit, marges de cr\u00e9dit\u00a0: disparues. Remplac\u00e9es par un seul versement hypoth\u00e9caire sur une propri\u00e9t\u00e9 qui vaut plus que le prix de transfert initial.<\/p><p dir=\"ltr\">Un compromis sur lequel il vaut la peine d'\u00eatre transparent\u00a0: le prix d'achat officiel plus \u00e9lev\u00e9 entra\u00eenait des droits de cession immobili\u00e8re un peu plus \u00e9lev\u00e9s en Ontario, ou des droits de mutation (la \u00ab\u00a0taxe de bienvenue\u00a0\u00bb) au Qu\u00e9bec. Nous avons expliqu\u00e9 ce chiffre \u00e0 la famille. Ses liquidit\u00e9s mensuelles sont nettement meilleures qu'avant la transaction, parce que le versement hypoth\u00e9caire, m\u00eame sur une propri\u00e9t\u00e9 de plus grande valeur, co\u00fbte moins que le fardeau combin\u00e9 de son ancienne hypoth\u00e8que et des dettes de consommation qu'il remboursait.
